What would U do w/ this acct. rpt?

    Brief background.

    Taxes were filed Apr. 9. Refund arrived on the Apr. 12th. Notification came that refund was in error about a week later. We immed. filed claim, H&R processed it.... cut check on May 18. All along, issuing bank (Imperial) has been kept in the loop. Imperial receives check on Jun 2.

    In the meantime, Imperial places a derog on CR.

    Here is how the CR reads and I'm not sure what to do with it.

    It shows up only on EQ and shows Apr/May/June all as "ok". However, remarks state: Paid collection. Acct closed by crredit grantor, at least 120 days or more than four payments past due.

    Obviously, it couldn't be 120+ late. It's marked "ok" but then they "paid collection" and other comments worry me.

    Will others see the derog comments or just the "ok" as far as status. How can they conflict? (I know, someone is a moron.)

    If I dispute it, how do I dispute it to correct it and move it as a positive on my CR?

    #1) The REFUND didn't arrive 3 days later. The REFUND ANTICIPATION LOAN arrived 3 days later. There is a major difference. RALs are similar to payday check loans. They are due on a specific date, and if the refund is not received by said date, then IT IS delinquent.

    Did you *PERSONALLY* notify Imperial, or rely on H&R to notify them?

    If you *PERSONALLY* notified Imperial, then I would suggest a goodwill deletion by sending them copies of the letters which you sent to them.

    Was it H&R who made the mistake with the return?

    If it was them who made the error, I would complain to H&R, that your credit report is being injured because of their mistake, and you will hold them liable for any damages that their mistake causes you.

    Hi jam237. Thanks for responding and yes, you are correct - my mistake.

    We did --- many times, have names and dates.

    :( Life prior to CN, it was all in verbal converstation. However, I do have dates and names.

    I've shared that in our phone conversations but not the part about "liable for damages". They are supplying me with a letter to give to Imperial stating that is was their error along with the dates. As long as they are being cooperative, I hesitate to mention the word "liable" just yet.

    From what you're saying, maybe the H&R oops letter along with a goodwill deletion letter would help. BUT do I want it deleted? Can't they just fix the 120 late / paid collection part and then leave it as a + tradeline? That would sure help - can I ask for that specifically in my letter?

    The problem that I've run into in trying to 'correct' something to positive like that, is occasionally the 'correction' will only cover the payment history, and not the 'xx days late' notation, which would leave the trade line stay negative.

    I had to have my state student loans resubmit the information about 4 times, before reluctantly having the CRA 'DISPUTE' the information to get rid of the negative comment.

    Then I had to call the state student loan agency to make sure that they understood that I wasn't disputing the account, just needed them to notate that the notation had to be removed.

    You would think that a 100% clean payment history and 1 time 60 (or 90 depending on which account it was) days late would be mutually exclusive, but they claimed that the update only left them correct the payment history, and not the payment history notation.

    So, it may be easier to just ask that it is deleted so you don't have to worry about only a partial correction.

    Maybe a goodwill letter of correction from my atty? Or does that take "goodwill" out of it then?

    Well, I think the problem comes from the creditors not comprehending that the payment history, and the comment regarding the payment history are two different things.

    They can zero out the adverse payment history, but the CRA (at least one of them) doesn't automatically zero out the comment for the payment history.

    You may once they receive the goodwill letter, and the letter from H&R saying it is our fault, not hers, want to try disputing the account as NEVER PAID LATE, CLOSED AT CONSUMERS REQUEST. That would dispute both the late & closed at credit grantors request comments, then they should get the comments on the verification request.
