1*but if the SOL (I.E., reporting period) is up then there's nothing they can do, right? 2*If that account is deleted from the report they can't put it back on! 3*Allow the 7 year law to work for you. SoParkDiva ********************** 1*WRONG They can sue get a judgment or get a garnishment. The expiration of the 7 years does not wipe out the debt! Get this if you don't grasp anything else! 2*They can and do: Happens all the time! 3*What you suggest allows the 7 year thing to work against you. 1*Do you not understand 2*Do you not understand that just because something is not being reported, it doesn't mean it is uncollectible? 3*I will say it again, it is absolutely 100% irresponsible to pass out advice - wait seven years and all is good in the world again, 4*It is also here for those people who, out of personal choice, want to clear up past mistakes and want to know the best way to proceed and limiting the damage to the Reports. It is here for people that want better credit cards because they think it is ridiculous to pay 21% interest with interest rates at an all time historical low. 5*If people have found their way to this board, they are not here to get a response - aw shucks just wait 7 years. They have pretty much decided that is not what they want to do! jlynn ==================== 1*There is a lot the Diva don't understand. Which explains the bad advice. 2*The 7 years to Dive is the silver bullet 3*Worse yet it misleads the newbies who don't know any better than to buy into it. Sorta like the blind leading the blind and they are both heading toward the edge of a cliff 10 feet away. 4* waiting for 7 years is certainly not the best way. 5*I like this one. The Diva don't quite stand under it. THE END ** *** ** LB 59 """""""""```~~~```'"""""""""
No, lbrown59, you are wrong. When the Statute of Limitations has expired, the consumer enjoys an "affirmative defense" against any legal action which is brought. Good grief, man, please don't frighten people with misinformation. If you don't know something, just don't guess about it. Doc
And you would do well to understand what you read in a post before shooting off a response that has nothing to do with what was said in the post!!!!
1*I still have 3 others that are due to fall in Oct and Nov. 2*Would you just wait out the time at this point, or try to speed things up with validation. One shows an amount of $9300, the other 2 don't have an amount listed 3*Would you dispute again with CRA after I get green card back bigdummy ================== 1*-These are so close to 7 yrs.Might fall early if disputed. 2* Are these With OC or CA what are they for? Is the Sol up on any or all of them? 3*Yep THE END ** *** ** LB 59 """""""""```~~~```'""""""""" You feel stuck with your debt if you can't budge it'. A lot of money is tainted. 'Taint yours and 'taint mine.
Wow, I never thought my post would garner this type of excitement! Well, as I mentioned I have sent a validation request to the CA, just recieved green card today, and disputed online again. As for the other 2 (yes I believe they are with the OC), here is my feeling: After reading all your posts, and also the sticky on credit mistakes people have made; one jumped out at me about leaving things alone that are ready to drop. So, in this instance, I'll be in divas camp, and let them fall off naturally. It's not worth messing up just to get a clean report 4 months earlier. Had I known about this board three years ago, I certainly would have felt differently. 7 years was a long time, and unfortunately, when I was in this credit nightmare, I thought waiting was my only option. The one thing I did know was to C&D the CA's. I'm telling you, I must have had 30 green cards at one point for all the letters I had sent to CA's over a 8 month period. BTW, the online Certified Mail service with the USPS is great. It costs an extra $1.50, but it is so worth not waiting in the post office lines.
SoParkDiva look at this http://cardreport.com/laws/statute-of-limitations.html CRA it is 7 years max, SOL completely different on which state. SOL which is reality says when to not worry much about a debt. Can they collect after the SOL? No. Do you have to sit there and take it for 7 years? No. In some states the SOL runs longer than 7 years. In some states it is much shorter than 7 years. The OP if I can remember is past the SOL. Others can look at this who are not past the SOL and just think 7 years. If they sue just before the SOL, MORE YEARS!
bigdummy, I just found out about USPS last night. Good to hear you like it. You just download the postage for labels to your printer, pay for the postage online and drop it in a mailbox. Sounds easy enough. Have you ever tried or compared it to using www.stamps.com? I must try using one or the other.
Gretchen, its even better than that. You can write your letter online, they print it out, stuff it in the envelope, address it and mail it. Its all automated! You don't even have to get off your butt! The $5.72 charge covers everything. If your letter is longer, extra pages I think are 3 cents more. Here is a link to read all about it. This is the best thing since sliced bread! CMRR the CA's and CRA's without leaving your chair!!! HA! HA! HA! You got to love it! http://www.usps.com/netpost/certifiedmail.htm
Thanks J. Vick! Excellent link! This link should be a sticky. People in California have the best SOL's they are very lucky. Sometimes CA's, banks weigh certain factors to see if it would be worth it financially dragging someone to court. And they do easily give up if the SOL has expired! Again, GREAT LINK! =)
Thanks Doc =) Hmmmm.... funny, when I say this I get keel hauled :/ Great post! *Diva does the happy dance* =)
I may not agree with your views but I will give you credit for this is a well thought out and well written post. =)
Re: Re: What would you do at this stage? SoParkDiva, I am going to go through this one with you so you understand, cross my fingers. People in California only have the best SOL on "oral agreements" Oral agreements are not dealt with much on this site because they have nothing to do with credit cards, auto loans, or installment loans. Look at the chart on the link I have provided to help you understand this. "open accounts" = credit cards most of the time. "written contracts" = auto loans and installment loans most of the time. "written contracts" can go up to 15 years in some states. Yes after 7 years CRA's are required to remove the item off of a report in most cases. This is what happened to you in your personal situation and it worked for you. In other personal situations your advise may be helpful to people that have gone past the SOL on their old accounts and have not been sued. Remember to find out what state you live in and look at "written contracts" and "open accounts" for the SOL. Also you do not have to sit there and take it for SEVEN years. It is possible to have an item removed before the seven year mark. But in reality you could still owe the debt that would fall into "written contracts" or "open accounts" depending on the state you live in and which of the SOL the debt would fall under. That is were a lawsuit and then judgment comes into play. If a judgment is entered on your credit report, SEVEN more years. Also they can be renewed in some states. CLICK on judgments to find out the term limits on these, up to TWENTY years. If you live in Michigan look at the possible 21% interest. Does this help a little??? I am not an expert but I had 3 of them. One was years after the debt went bad and just before the SOL came up. Actually this might help others that have had items removed from their reports, but still owe the money in reality. Careful of the SOL.
Re: Re: Re: What would you do at this stage? I've seen it. I'm still digesting it and I will respond. I just don't want to come off sounding "stupid" or anything. :/
bigdummy, Wow,,, that does sound easy. I will try it at home first. ;-) Maybe send my neighbor something and see it in action. Thanks again,
I am NOT going to comment on all the discussion on the other posts-- I will say that you need to IMMEDIATELY Opt Out!! If you do not do so, all of the "old" accounts and some that you may not even know of, will reappear as re-aged with different account #'s just as you get ready to close on any mortgage.
WhyChat, I Opted Out after I got my reports recently. The accounts appeared to have already been re-aged with different account numbers. Talk about confusing! Although in my case, I am certain it had nothing to do with seeking a mortgage, CC or any kind of credit. Since I have taken no such actions towards seeking credit since my hardships. I was under the impression Opting Out keeps out promotional stuff only. The CAs are still allowed in.
Re: Re: Re: Re: What would you do at this stage? SoParkDiva, don't worry about coming out as stupid. I am not a female so I understand that there is alot of things I do not know that you probably do. Do you understand this? All I am trying to do is offer what I know to help you understand what many other people did not understand many years ago and probably will not admit it. Alot of members here including myself have been screwed by the CRA's and have been sued unlike yourself. The CRA's and creditors are so nasty to others like myself. The CRA's report things that are not true and re-age accounts. An individual like myself can not even get results like the way they are suppose to be. It is all a game that they make us play or give in to what they are doing. Do we just sit here and take it or fight back? The people against your views are the ones that fight back. I personally have accounts that are re-aged, past due, and this is after a Bankruptcy. I was really forced to learn the SOL, dispute, validation, and etc. That is why the vets or pros give us advise on how to do this. I think maybe you are a little ticked off that you waited 7 years to get these results. When others did not have to wait. It is a HARD fight and you are very lucky for not having to do this. I do envy your scores and respect what you have been through. I just don't want you to give advise that might hurt other people going through it now. I am sorry if others like myself put words in your mouth. They are just protecting others and have been through it.
