What's a Girl (Roni) to do? Help!

    Hi Guys,

    It has been awhile. To the old timers on Creditnet. What's UP. I have a BIG question. I have been out of the credit repair for a while so I need some current advise.

    I have a new collection from the ARMY. Long story short. I was in the army reserves, got out when I had my son (he's almost 2years old). They gave me a bonus and now want part of it back. I got $30,000 total and they wanted $10,000 back. (I wasn't trying to go to IRAQ w/ a new born).

    Anyways, I tried to make payments on their payment plan, twice they returned the payment sheet to me due to incompleteness and within 4 months they then turned it over to a collection agency who is not hot on my tail.

    SO, I am now wondering should I settle. They now want $13,000. I am sending the collection agency a cease and desist b/c they are calling my office.

    I am thinking since the army turned it over to a collection agency will they be able to garnish me? Wouldn't the government garnish me first.

    Basically, can you guys help me plan this one out? I would really appreciate any help.


    BTW, my business in growing (I am a dentist), my son is beautiful, and I hope everyone else is doing well.

    Did you determine that their amount requested for refund of bonus was consistent with the terms of your enlistment agreement?

    Thanks for responding. I wasn't enlisted. I was a commissioned officer but that really doesn't matter now. The amount is considerably different with penalities, late fees and on and on. The army asked for the $10,000 back. That's fine. But the agency is now saying the amount is $12,993. I assume that have attached to the original amount. Will I be sued? I don't think a collection agency could sue me. Why would they give it to a collection agency when they could easy garnish me? They have already listed this on my credit report in 11/04. Thus my hesitation to pay this thing now.

    Roni,

    Glad to see you back, but sorry you have problems.

    I don't know the answer. I would think the government could garnish much easier than a CA. Why don't you do a validation letter for the amount. Say you don't agree with it and make them give you an accounting of it. That buys some time.

    In the meantime, can you maybe contact the JAG office or the pay office and see if they can offer some advice? Maybe a way to get it back on a payment plan.

    hey roni!!!. Nice to see u girl. I remember u very well. you was the first person who told us about citi and the aadvantage silver and gold cards deal. My cards have huge limits right now (I have like 60K in 3 citi cards). But i remembered u had some troubles with yours, sorry.

    I Didnt know either that you have had a son. Congratulation!!. Even less about the Army job. You just had dissapeared from here from 2 yrs ago(?). I also remember when u established ur dentist office in (was it in NJ or PA?).

    I can not help about your question today. I just wanted to say hello to you and tell that i appreciate u so much for ur help in the past when i was bulding my credit from year 2000 i think. Damn 5 years ago!!. A long time. See u roni. Take care and good luck!!!

    Hi Geo,

    I joined the army reserves in 1999. I did that for student loan repayment and the bonuses. BUT, that was B4 GW43 and 911. I had my son in 2003. I am a single mom, raising a son and running a business. I opened practice in NJ. I LOVE IT. My pregnancy (was on bedrest for 4.5 months) thru me back big time financially. It was my oversight I know missing getting the payment in to the army people.

    I wish somebody knew what I should do.

    BTW, I am back on track with Citibank and all other her cards now. To tell you the truth, I am not worried about my credit rating anymore. I got my mortage, Lexus, business and son along with some nice plastic to charge a thing or two here and there. I will wait for this to fall off in 7 years. Seven years seemed like an eternity before.

    Thanks for your reply. it was good to heard a little more of ur live. I know those student loan are terrible to deal with but I know you will do fine.

    This happened to me when I joined the National Guard after serving regular duty. The goverment will take your tax refunds until they get their money. If you dont have any refund coming in they are kind of like the IRS in their ways to get their money. From trying to attach your wages to getting a hold of your checking account.

    They took my state refund until they got their $1300.

    Ok, Thanks. I thought that was how they may handle it. I was surprised the Collection Agency was on the case. I would much rather pay the Govt back over time than pay the collection agency. I plan to get off a certified Cease and Desist letter tomorrow. My income tax check from last year was almost $10,000. I should be able to pay this off quickly. I knew someone would come through for me. Thanks for your help.
