Good afternoon guys, I've been lurking on this board for a while now and I've posted a few times (as judgment and chargeoffs). I've been cleaning up the mess that they ex-boyfriend left behind. So far I've made settlement on the loans (written contracts) and am hoping to make a settlement on a loan that I stupidly consigned for at some point next yr. I have a validation question. I've sent out validation letters right before Thanksgiving to three collection agencies (NCO-for AT&T Universal Student Mastercard, some law firm-for an American Appliance credit card, and Attention LLC-for Best Buy credit card) So far, the only one that has replied has been Attention LLC with a letter for a settlement offer, no validation and it has not been thirty days yet. Should I reply with an estoppel letter? Also, I need to send out validation letters for a few other credit cards. I have not heard from the collection agencies for the other credit cards in a while. Should I just send the validation letters to the collection agencies listed on my credit reports that I ordered in Sept.? Also, I have a weird situtation with MBNA. I have one credit card in good standing since 1999 where it was originally held at First Union, but since earlier this yr. MBNA owns it. I have a chargeoff with PNC Bank credit card that carried over to MBNA since that bought that card. Also, the MBNA chargeoff is reported a couple of times on one of credit reports. One listing is reading as paid in full. Should I write a validation letter to the collection agency that it was transferred to? Or should I just dispute it with all three credit bureaus? Or should I call MBNA, tell them that I've been in good standing and never heard of the other debt. Thank you in advance for your advice. Sorry for the length.
Sorry, I'm between one vocational exercise and another, so I can't even delve into your question quite yet. Hopefully somebody else will. But here's a tip for better living regardless: Before you bump a message, give it at least 12 or 15 hours. Although it certainly can net a quick answer, it's also common for a question not to be answered in its first few hours. Doc
Re: PLEASE RESPOND!! I think the problem is that you have put so many questions into one post. It would be time-consuming and mind bending to answer then all at once. Try splitting them up and posting them separately. I will make a suggestion on this one: It depends on how recently these accounts became delinquent. Sending a cease communications on a fairly recent delinquency can get you a court appearance, and possibly a judgment. If these accounts appear on your credit reports, send your proof that they received your VL, (the little green card from the PO and a copy of the letter) to the CRA that is reporting them and tell them the CA did not answer your dispute. Since they could not prove that these were your debts, the CRA should remove the entry. If I have time, I will answer more, or perhaps someone else will take on one of these issues.
Re: PLEASE RESPOND!! Thank you guys....sorry that I put some many things in one post. I guess that it's the anxiety. All of my chargeoffs are from 1999 and 2000.
Re: PLEASE RESPOND!! Try sending estoppel letter to the ones from 1999 and see what happens. What state are you in?
Re: PLEASE RESPOND!! I am in the dreaded state of New Jersey where the statute of limitations is 6yrs. Thank you for help...I am very scared as I never planned on paying for someone's else's debt that is in my name. I have settled all written contracts, except for the one that I consigned for (hopefully I can deal with that next yr.) Also, I am paying on two judgments. But I am trying to see if I can do something about the other credit cards. Thank you again.
