On my EQ report - I had disputed a Sears account and the prior paying history was deleted. Then it read: CLOSED ACCOUNT Revolving - pays as agreed 11/93 Opened 09/02 Updated Balance $1717 Payments $39 High Credit $0 On April 14 it still looked this way. On April 15 when I pull my report thru CW, this is what is shows: Balance $1716 Payments $41 High Credit $0 Revolving pays as agreed Opened 11/93 Updated 04/03 Paying History 90+ days past due 01 times. CONSUMER DISPUTE FOLLOWING RESOLUTION Ok, they lost me with that last statement. I haven't disputed it again although I have been trying to find a way to get them to report my current balance as my high credit. I know that's killing me. I went to all the work to get the lates removed back in November and now this 90+ shows up. I haven't been late at all in at least 2 years on this account. Any thoughts? Thanks!
I don't know when the lates were but I know they will show for 7 years. I guess my real questions is whether or not I can do anything about the fact that back in November 02 (and I have the sheet they send out in the mail that says "prior paying history deleted") they deleted all the lates and now there is one showing up as 90+ days. And what's this comment at the bottom stating "CONSUMER DISPUTE FOLLOWING RESOLUTION" mean??? I haven't disputed it again for that very reason - I didn't want them re-inserting a bunch of stuff on it. I know there were some lates and I managed to get the removed through the first dispute and now this. I swear, it's one step forward.....
Did all of this take place during a 30 day dispute period? Or did they delete the lates, end the dispute, and they have now magically reappeared? If it was magical, I would do a search on reinsertion.
I disputed in Nov. last year. The lates were deleted and the account updated with no lates showing. I have the sheet they sent stating that the prior history was deleted from the account (i.e. they couldn't verify). Beginning 3/03 and into 4/03 they show (different at that) up and the number of them keeps changing. Somewhere in the last month the statement shows up at the bottom even though I never requested another investigation or took any action whatever concerning this account. They seem to have a habit of showing things in dispute that I didn't dispute. I also have a Discover account that has been showing up continually as "in dispute" for about 90 days now. They just did that on their own. I kept hoping it would go away even though I didn't dispute it (I had disputed months ago and got verified) because it's got lates too and is over limit. Looks like it will sit there in dispute forever unless I can find a way to get them to delete that as well. Guess I hijacked my own thread, lol. Anyway - they just like putting my stuff in dispute I guess That would be fine if they ever FIXED anything. UGH. Also, FYI - I'm dealing with CSC. I was wondering if there isn't any way I can call their hand based on the fact that they keep (supposedly randomly) changing the number of lates and putting items in dispute when I have not initiated any action on those accounts. How can the number of lates change from week to week??? Thanks for any help. It's like the more you ask and try to fix the worse they make it! I'm determined not to give up on this but understand why so many do
From Sec. 611 FCRA B) Requirements relating to reinsertion of previously deleted material. (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.
Thanks Jlynn. I'll get the letter off to them right away. I hope it's as simple as writing a letter but somehow I suspect with them it won't be. I'll also search on reinsertion before I do that and see what other good info I can find. I never received anything about it being reinserted and I'm sure they have no proof - they can't even decide how to report it! Thanks again.
