What's up with MCM Midland?

    Received a letter today talking about, we bought your account, blah blah blah and we will settle for 50%. Well I bet they would! The letter is not even addressed to me! It is addressed to Paul ______
    and I am not him. The last name is the same but not the first name. This may in fact be a debt once owed by me or my ex but since they've bought it and now begun corresponding with Paul and not me, where does that leave me? Should I not respond at all or should I acknowledge them or what? I've used validation in situation where the debt was mine and I disputed the amount. However I have not ever had one where they got the name wrong.

    CORRESPONDENCES YOU WANT TO SEND PLEASE INCLUDE A CASHIERS CHECK FOR $100 PAYABLE TO BARER

    Well, if it turns out that it's mine and they come after me in court, will I be up the creek with no paddle, or will I just tell the judge I am not Paul?
    After all, I don't know what records Midland has at their disposal. Maybe validation would be an option? The debt is within TX SOL and the amount is somewhat large......they say $8500 but I have no proof from them. Help.......kinda confusing. I've read all the validation posts and been on the boards for awhile now but this one truly stumps me. I just know that I must be very careful so I don't gett too excited over their screw ups and screw up myself.

    I think I might validate. Just don't put your name on the letter. Send them a copy of their letter. Just because the name is wrong doesn't mean they don't have the right SS # somewhere.

    Thanks for your thoughts jlynn and george. i am going to have to think on this one. i tend to lean towards what jlynn says but then again i guess even if midland were to get a judgement it would be pretty easy to have it vacated if it appeared on my CR as I am not Paul and Paul is not I..........have to chew on this one awhile, at least for 29 days or so......lol!

    Hell, accept service for Paul. You'd likely be doing him a favor! By the time he realizes they've got a judgment against him that he can easily vacate for defective service, the SOL has run on their claim against him.

    This notice is my response to your unsigned letter dated December 1, 2003 [copy enclosed].

    As I have no account with you, nor am I your customer, nor have I ever entered a contract with you, nor have I ever even heard of you and the addressee does not reside with me, I must ask you to provide the following information:

    1. Please evidence your authorization under 15 USC 1692(e) and 15 USC 1692(f) in this alleged matter.

    2. What is your authorization of law for your collection of information?

    3. What is your authorization of law for your collection of this alleged debt?

    4. Please evidence your authorization to do business or operate in this state.

    5. Please evidence proof of the alleged debt, including specifically the alleged contract or other instrument bearing my signature.

This Notice is an attempt to correct your records, and any information received from you will be collected as evidence should further action be necessary and this notice is being provided to you as a one time courtesy.
