Hi Everyone, My spouse filed bankruptcy 10 years ago last January. We pulled her credit report and the bankruptcy had dissappeared from all major credit reports as well as the accounts histories that have bankruptcy. The credit report is clean. We are applying for a mortgage. Several lenders asked us "have you ever declared bankruptcy?" What the proper answer that my spouse should say since the bankruptcy and any other related items to bankruptcy are no longer in the credit files? Thanks
The information may still be in the file, it is just not reported. They can keep the information on file, and may report it under Section 605 (b) if you are applying for a mortgage over $150K. So, be careful how you answer that. http://www.ftc.gov/os/statutes/031224fcra.pdf
