When Does SOL Really Start?

    Will I Get Sued?

    Hi, I am in Texas and my last payment on any of my Credit Cards were in Spring of 2004. I now get about like 1 call a month from one of the collection agencies and 1 letter about every 3 months from one of the CA's.

    What are the chances I will be sued? I did apply for a CC back in 2007 which was approved for $300 (now have a $800 by request) and have a flawless history with full payments every month. I do have to pay a $5 a month service fee.

    If a CC debt is not listed in any of the 3 Major Bureau's then does that mean I do not owe any debt?

    Almost my credit has dramatically improved in the last 2 years from like 370 to last time I checked was about 6 months and it was at 600.

    I don't know what the chances you'll be sued are, but you need to check the SOL in Texas. It's quite possible that these debts are out of SOL, so if you're sued you need to respond and raise the affirmative defense that it's past the Statute of Limitations. Whether or not it shows on your report has nothing to do with whether or not you owe it.

    I know that Texas has a Finance Code that is consumer-friendly and if you are sued, you need to look to the Texas Code as opposed to the FDCPA as it offers more protection.
