Does the day one starts an investigation count as day 1. Yesterday I checked on Equifax and it said estimated completion date 10/10/02. Just checked today and it states 10/11/02. This is how it looks. Date Investigation Started 10/08/02 Estimated Completion Date 10/11/02 If I am adding correctly, the 30 days should have been today, or at the latest tomorrow. I know, I know, itâ??s only two more days, but these last few are driving me crazy. Also, this my be some kind of violation on Equifaxâ??s part. Can anyone please clarify this for me? Thanks so much. Sandie
http://www.ftc.gov/os/statutes/fcra.htm#611 § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (a) Reinvestigations of disputed information. (1) Reinvestigation required. (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer.
Technically it begins when they sign your CRRR. But in reality a day or 2 to get the dispute in the system is perfectly acceptable, I certainly would not want to be that picky in front of a judge, you would lose (and really the only thing violations are worth, is a law suit, right?). I do not think what you have is a violation, but more of a data entry error...called a typo in the old days Cross your fingers and stop thinking about it for a couple days .... oh yea you also have to wait for the results to be mailed, so relax a bit -Peace, Dave
Hi Dave!!!!!!! I just thought of something, I'm not disagreeing with you, I'm nodding. But it seems like Christi at one time had initiated a dispute online and at some point during the 30-days the CRA changed the dispute due date. She had printed out the online pages showing all the information. I don't know that it is the case nor that it's worth 2 days, depends I suppose on the outcome, and too, whether the results are received online or in the mail; first dispute etc. -- that's not clear either. Sassy
Hi Sassy Nodding right along with you...we probably look like one of those dogs in the back of car windows, or those bobble headed sports figurines LOL I remember that too, Im just saying the 2 days is "technically" a violation but I would not want to be in front of that judge with a 32 vs 30 day response time. The fact that they mistakenly entered the start date as October is just a clerical error, the results will probably arrive with a verification expiration around the 10/11 date. However, if they try and go for 60 days by saying the dispute was REALLY entered 10/8/02, then I would take a different approach and I would look into how Christi handled her case...(BTW Sandie others have done the screen capture thing here too for this kind of problem, searching will be tough, but you will get some good collateral reading while you search . Nice nodding with you Sassy, are we tired of doin the bump? I kinda liked that action..."do a little dance, make a little love get down tonight, Thats the way, uh-huh uh-huh I like it, uh-huh uh-huh" -Funky Peace, KC Dave and the Sunshine Band
oops, I made a mistake on the dates. It should say: Date investigation started 9/8/2002 Estimated completion Date 10/11/02 So actually, it will be four days past 30, but who's counting!!!!!!!!!!! I am just courious as to why they changed the completion date overnight from the 10th to the 11th.
LOL Dave, Heck no, I'm not tired! We can nod AND do the bump at the same time. See the talents one acquires on credit-net ;-) Sassy
Well Sandie, There's the REAL question, WHY indeed? We don't know that's why we nod and bump ;-) It's more a matter of picking and choosing your battles, the whys never do seem to be resolved. Sassy
When it gets to the last few days of the 30 day dispute period, and they change the completion date, that is because they are updating your report. It happens all the time. Chances are whatever you dispsuted is being deleted, or at least some are being deleted. When you check the status tomorrow, all dates most likely will be gone by then and it will show no active disputes. That is when you either call or pull a new one online for the results. It may take til Thursday, but probably not.
