When is statute of limitations not?

    California has a 4 year limit of statutes, yet I'm told that it doesn't matter and that creditors can still come after you. Why then do we have statutes of limitations.

    SOL applies to them being able to file a lawsuit to collect.

    Let me guess, it was a CA who told you that the SOL doesn't mean anything?

    Does that mean that they can do whatever they want? Check the thread in my signature for a comprehensive discussion on SOL.

    As long as you are alive and breathing, collection agencies can call you and send letters in an attempt to convince you to pay. However, once the SOL has past, they cannot legally sue, however if they do then you must show up in court and assert the SOL as an affirmative defense. Otherwise, they will win a default judgement, and begin garnishing your wages and/or bank accounts.
