Where to start?

    hello,

    Was going to call myself dumb and dumber but hoping to change that.

    I know nothing about finance and credit. And frightened to death of my own shadow at this point. Don't know who to trust and where do I begin.

    My house was foreclosed in 1999 in Cal. and now I reside in Nevada. They sold the house and sent me the extra 45,000 dollars from the sale after they paid the mortgage. The foreclosure I am told is on my credit report. I imagine the hospital bills are there along with a few other thousand things. I am healthier now and have a job.

    So, just send for a credit report, any brand and or all three? *grimace* and then send for a shovel and start digging?

    Send for all three. They tend to have different information on them. Some creditors may report to one or two, but not all.

    Quit retching, and start reading this site. The intro threads are a good start!

    Get a Tri-merge report and then decipher it. Study these boards, there are a lot of people here who have been down the same road you are on who can guide you every step of the way. believe it or not, you have a lot of useful friends here.

    Things aren't as bad as they might seem.

    1. Even though there was a forclosure the bank got paid in full and you got some money. Many here walk away with no house or money.

    2. Living in NV will give you a little edge if the medical bills were in CA. Read up on getting old address removed.

    3. Coming here puts you a lot further down the road then if you just wait out the 7 years.

    heh heh yeah ",,,, and Dumber" she said. HAD is the key word here. It was bad blood money. I found this forum as a link while getting wiser over at Fatwallet's forum.

    Been soaking up all the new words and information all day. Amazing how many people coincedentally have the same questions as I do.

    Right, the house was paid in full. Animals have been known to chew off their leg in order to be free of a bear trap and thats exactly what I did.

    *Nevada hospital bills. The fact that they have records of treatment that contradict themselves that led to my demise might give me some leverage.

    I will return with my credit records and Equifax FICO scores.

    You all have me very interested and feeling capable. No time today to search out why BLUE AMEX is such a hot card to have. Off to work.

    Well, for starters, let go of the fear. It sounds like some pretty bad stuff happened in your past, but it's all behind you now. You can't change the past, but you can build a better future. From now on, every step you take will be a step forward, even if it doesn't always seem that way.

    Yes, ordering the credit reports is the first step.

    I subscribe to several services, but I find one that probably will be useful to you is privacyguard.com. They have it where you sign up for $1.00 via credit card and you get three months free. You can pull your report from all three CRAs. The only downfall is they do not allow you to dispute on-line, so you would have to mail everything in for that.

    I pulled the reports from PG like you suggested.

    Trivia Question:

    What does the Cowardly Lion in the Wizard of Oz repeat over and over with his eyes squeezed shut while confronting OZ for the very first time?

    I can't remember, gheesh, I can't seem to remember half the stuff on the report but that is where I was at a few hours ago. Now I am at a FICO score of 589 with 0 public records with a great sense of urgency.

    I will come back here with questions after reading my next step and figuring out what my priorities are. Or, should I post new?

    I do believe in spooks.

    Sometimes its easier to take baby steps to start. Unpaid collections? Any paid collections? What kind of stuff are you looking at? Before you go hog wild, if anything is unpaid you have to watch out for statute of limitations.

    According to this source , the Nevada SOL, my states SOL is 3 years on debts, 10 years on judgements.

    Many of the links I tried on Google were dead for Nevada including the one listed in Credit Talk in the Unofficial FAQs post.

    I hope this link I found is an accurate and reliable source. I am going to look for another link to confirm it.

    Compared to other states, I imagine 3 years is a good thing, if accurate that is. I was expecting 7. Maybe I am misreading it?

    Presently, I am having difficulty grasping onto how to use this SOL information in relation to my report. I'll keep reading the archives until I do.

    You have to look at the SOL in two terms

    SOL to report on your CR = 7 yrs.
    SOL to collect a debt varies from state to state. What I found for Nevada (and always double-check!)

    Oral Agreements = 4
    Written Contracts = 6
    Promissory Notes = 3
    Open Accounts = 4

    Open accounts are accounts like credit cards. I *think* medical bills are promissory notes. Will need that clarified as well.

    Now, anyone is free to collect a debt, regardless of the age. That is not illegal. An SOL defense is an affirmative defense, which means you have to raise the issue.

    When you start repairing your credit, you will find that you will "wake the beast". That means some CA's that may have been laying low, not aggressively collecting, will ratchet up their efforts. Its not uncommon, and it has happened to me.

    If you start disputing a tradeline in SOL, then you will need to consider being prepared to pay it off if push comes to shove.

    If the SOL is expired, then you can pull their chain til the cows come home, and the most they can do is be an annoyance :)

    That's the short version! And please don't start retching again LOL, it is not all that complicated once you get everything straight in your head.

    Are these the same company? Same debt different amounts?

    Need to find the Date of last activity (DOLA) on this. When was the power shut off?

    Well now isn't that just interesting


    Need to find the DOLA - EQ is the easiest to figure it out on.

    ET needs to phone home. If it has been transferred to another lender it should show a -0- balance.

    I didn't mention in the other post the SOL starts from the DOLA. Here's some more homework

    Ok, I'm confuserated! Not your fault. I don't have privacy guard so I'm not sure what you are looking at. That is one of the reasons alot of us recommend getting an individual report from each CRA the first time around, then you don't have such a hard time dissecting the tri-merge information.

    There is a DOLA --this is the date certain to determine how long they can report.

    Some of this stuff is still in SOL. I think I would send dispute letters to all the CA's reporting at under $1k to start. Once you receive the green card back, dispute with the CRA's. That might clear the clutter where you can see how to tackle the rest.

    The big account $5K from 1998, you should be safe to do anything you want with it. There were a few over $1K, and if they are still in SOL, are you ready to pay for deletion?

    • I wish I know which collector I owe COX Cable for. Do you think Cox will tell me the collector's name? Should be $180 bill buried in there somewhere but it is not. But I want it sweeped off my report. As I understand it, Had I now sent COX the $180 I would have a PAID BAD credit left on the report till the SOL.
    • Are those balances in the report including the interest charges and collectors fees? What I am asking is when I do awake them will they ask for more than what I see? Or,,, will I be negotiating for less then what I see? Clear as mud?
    • Is it possible that CA passes or sells debts to other CAs and more than one debt on the report at the same time? Because, Safe Management the biggest and NEWEST MAR 2003, bill collector makes absolutely no sense to me.
    • Which is my worst debt? Safe Management or can I not determine that?
    • How can this be? I only was in the hospital mid JUNE 19, 1999 for two emergencies no overnight stays. I have 2 unpaid ambulance bills, and a several small under $200 dollar tests! After that I lived off my money for two years and created $0 debt and paid all bills. There should be no new MAR 2003 charge for almost $5000!!! I have incurred $0 new debt since 1999.
    • Am I wrong to think that working for a CC institution or Bank that might make approval easier regardless of the FICO? or some perks at least? I was thinking of getting a second job to pay down my debts.

    • Are you sure this 1998 has not somehow resurrected from the dead as the MAR 2003 Safe Management bill?

    • If the SOL ends and they fall off, that is a good thing, right? Can they do worse after the SOL falls off the CR. I am certainly not blindly sending a unknown CA a check without validating it that is for certain mine, not already paid and not a mistake. If I understand correctly, my choices are either wait until they fall off or attempt to validate/negotiate till deletion is in writing/pay.



    There were a few over $1K, and if they are still in SOL, are you ready to pay for deletion? Yes, I am eager to PAY my debts but No, I do not have much to work with. I work on a commision only basis so it is hard to say. I have 2 checks coming in about 2 months for $2000.

    That's right - you can't roll over and "just pay" anyone right now. Do not call Cox. You will shake the OC's out of the trees via validation to the CA's. Um...why are you worried about this particular bill LOL?

    Can't give you an answer to that one. During validation they are going to have to show you exactly how they came up with amount due - seldom happens. Some of these will disappear without a dime out of pocket, some will probably stick like glue. Once they are identified, then work from there.

    Happens all the time. Mid bottom feeder to the lowest of the low bottom feeder.

    Safe Mgmnt can put today's date on their if they want, but there is still a date certain DOLA that cannot be changed without illegally re-aging. If it is the First Can CCA acct, you are OK as it is actually out of SOL. You may want to tackle it last...just to be safe. IMHO, other than Safe, your biggest problem is Acquisitions, as it is in SOL--whichever one is correct.

    Don't want to rain on your parade, but you may have difficulty, given your cr, getting a job in a financial institution. But, give it 60 days, and your file is probably going to be a lot purtier. I worked for a bank right after my divorce, and my cr was an issue. I wanted the damn job bad enough, I drug down my divorce papers to HR.

    Ok, you saw my answer above. Go ahead and dispute the Can CCA for sure out of statute debt -Safe Mgmt if they are the new CA will probably wake up, and start contacting you...we can shut them up fast don't worry.

    You did understand they can stay on your reports for 7 years, regardless of SOL for collections?

    If you go "balls to the walls" with this, in 2 months, you will have a better idea of who you have to pay what, then you can worry about negotiating. I wouldn't be surprised if you have enough money left over to take me out to eat when this is over :)~~
