Would that be the last date of activity (like last payment date), or the date of the charge-off? I'm ready to file suit against Gulfstate, because the date of last activity from the original creditor was 5 years ago. Gulfstate just sent me their 'validation' (which I won't accept) showing it was a charge-off in 1998. I'll call the original creditor on Monday to verify the charge-off date, but I'm wondering which date to use as far as SOL goes. That's my main defense.
They explain it here: http://www.cardreport.com/laws/statute-of-limitations.html Time to send a "cease communications" letter. breeze
