Who to dispute with

    Well, Transunion finally sent me a investigation result and a updated copy of my credit report.

    I asked for 6 deletions as "not mine" and they deleted one. This may not seem like a big success to some, but I am thrilled. It at least gives me motivation to keep going!

    Three of the trade lines were rather recent so I really didn't think they would be deleted.



    But one that bothers me is a mortgage with Saxon Mortgage services. I was never, ever late. Paid as agreed up to the date I refinanced. But they have the pay status as being "collections account". This came back verified but it it absolutely not true. So is my next step to dispute with Saxon?

    Anyway, my question at this time----

    Who do you dispute late payments with, the CRA or original creditor?

    Thanks for the help so far. I didn't even know this kind of stuff existed. I'm extatic!!

    I would say with Saxon Mortgage it is time for a letter explaining your request and why you feel the account is being improperly reported. Send it CMRRR so you have a paper trail to back you up. Be aware this is a time consuming process. I'm in the process of trying to get some inaccurate accts reporting properly (they were verified also) and they seem to want to ignore them. It'll be time to call them soon if they ignore my latest letter. And if that fails I will have to consider legal action. These are the Pita tradelines, no doubt.

    Late payments are disputed with the OC.

    "Speak softly, but carry a big stick" as FDR said....

    I would do three actions at the same time:

    1) Call Saxon Mortgage and ask for an explanantion of the the reporting as "collections", and

    2) write Saxon Mortgage (send CMRRR of course) requesting "verification" for the reported information.

    3) Write Transunion requesting a "Procedural Request" for how this tradeline was investigated and "verified".

    Your "big stick" is the "verification" of "collections account". If you know you were never late, then someone has commited a violation of the FCRA (Fair Credit Reporting Act), and is subject to legal action.

    Your task will be to find out who has made the error; and this will not be easy. Most likely, both Saxon and TU will swear it is the other party, and then you will have to threaten legal action, and say you'll just have the judge sort it out for you.

    Start preparing yourself mentally that this may be a case you will have to pursue legal action on to correct. Start gathering all documentation that you have, and record, or take great notes during any phone calls.

    In the meantime, you may want to add a "statement" to this tradeline that you state this account was never paid late, and customer disputes.
