I sent out a validation letter to a CA 33 days ago regarding an old credit card account that was transferred to them. The estoppel letter is going out on Tuesday, and I'm really not expecting to hear anything from them. The CA, however, isn't reporting the account...only the original creditor is. I used the validation and c&d letters to get the CA off my back for a few weeks and stop the phone calls. So here's my dilemma... Now do I send a validation letter out to the original creditor and risk opening a can of worms with them? I know the SOL isn't up yet, but I have no real ammo with the CA's lack of validation...they'll just pass it off to another CA. Could it be that this CA has just an agreement with the creditor and no actual proof? This account is definitely mine, so I know there's a record of it somewhere. Advice, please...
Did you read my post "What I learned from gulf state"? I can almost guarantee you that the ca has zero proof of the debt. And, depending on how old the original acct is, the original creditor may not have any proof either.
Thanks, LKH...it was actually your post that prompted me to throw this question out there. It brought up a few very good points and I wanted to see if someone could help tailor it to my needs without jumping into your thread . I figured on waiting until the SOL runs out, but it's 6 years here in MA...leaving me with about another 4 years if I wait. Might as well leave it the extra couple of months until it falls off and avoid it altogether if I do it that way. But still, it leaves me with the unpaid chargeoff on my report and an original creditor who's refusing to deal with me because it's been sold off to an outside agency. I know I won't get a deletion for payment (this is Cross Country Bank we're dealing with), and they're dealing with a CA who can't verify the debt. I guess somewhere down the road I should just mail CCB a check for the balance...who in their right mind wouldn't take money from someone who owed it to them? If anyone else out there has a better idea, PLEASE tell me. I'll consider anything right now to just get this thing settled.
