Capital One is the only negative TL left on my Equifax report. Itâ??s reporting with a 0 balance, closed by consumer, R9. I originally had an account with them with a DOLA of 6/96 but I made the mistake and reaffirmed the account under a different account number DOLA 11/98. Now the first one fell off and Iâ??m stuck. This account was never paid yet it is showing a 0 balance after several disputes. By reading the board I understand Cap1 is a tough cookie to deal with so I thought dealing with the CRA might be my best bet. What do you think of this letter? Does it make any sense? Should I go after Cap1 since according to them they canâ??t find a hard copy of an application that reaffirms the debt? As per the Brinkerhoff-Amason opinion letter at : http://www.ftc/gov/os/statutes/fcra/amason.htm â??Because the commencement of the seven year period is now described with some precision by the statute, it is our opinion that none of the subsequent events you listed â??sale of the charged off account by the creditor, or a payment on or dispute about the account by the consumerâ??changes the allowable period for a CRA to report a charge off.â? Enclosed please find a copy of my corresponds with Capital One, where it clearly states that the account â??â?¦.was opened as a reaffirmed balance from a previous Capital One account.â? Please note that the â??previous accountâ? refers to account NO. lllllllllll DOLA 6/96. In the event that you do not delete the item pursuant to the FCRA, and you continue to list the disputed item on my credit report I will find it necessary to sue you for actual damages and declaratory relief under the FCRA.
