I disputed most of the negative things on my credit reports a few months back. Now it seems that every creditor I owe is coming out of the woodwork after their money! Citifinancial is actually sueing me over $250 I owed them. It has now ballooned to almost $700! I guess I should have let sleeping dogs lie. A few of the things were set to fall off my report next year. Now that they have probably updated things on my report, will they still fall off next year or has the clock been reset?
Remember that you can't dispute accurate derogs off your report. The good news is those items should still fall off next year.
Yes, you CAN dispute accurate derogs off your report. Who told you you couldn't? Unless the CRA can VERIFY as 100% accurate/complete, the entry (accurate or not) must be deleted. Yes, you can still be sued after it drops off. Just because it drops of the report does not mean you don't owe it.
roshambo, there are those who have had bad experiences with CRA's, CA's which has left them bitter. You have to take some replys with a grain of salt. I had the worst credit you can imagine 9 years ago: student loans, a car repo, defaulted credit cards, etc. I financed a nice, new car with FICO in the mid 400's. Due to my excellent payment history I was able to acquire a secured credit card. All my derogs fell off my report as scheduled. I have never been sued by my creditors. Hope that answers your question.
SoParkDiva.... I agree. There are those who are bitter but I can assure you I am not one of them. In fact, I'm thrilled. I had a BK discharged in '98 and have since purchased a $195K single home. I was only able to do this AFTER I made the CAs and CRAs follow the laws that have been laid out. I hold grudges against none of them as I am actually quite happy. I also tend to dispute your claim of getting financing on a car with scores in the mid-400's unless you put a LARGE chunk of change down as your downpayment (which is possible). Also, can you direct us to the law that states a person is not allowed to dispute accurate derogs? I 'd like to see that, given the fact that I can produce the exact section of the FCRA that states all entries are to be accurate/complete or be deleted. Let's see if you answer the bell.
Re: Re: Whoops! Congratulations =) Yes, I had to put $2800 down. It's amazing how I was able to come with that amount so quickly but now that I'm paying my bills, it's difficult. =) *ding* Show me where I said you can't "dispute" derogs. I never said that. Reading other posts on the board I see where disputing accurate derogs is considered "frivolous" because they are verified 95% of the time.
Did you not say you couldn't dispute accurate derogs off your report here??? Where did it say accurate derogs were verified 95% of the time?
Re: Re: Whoops! I quoted you. You said what you said. Next time, when someone responds to a post, you might want to shy away from making accusations that they are just bitter. I've been around here a LONG time and I know what I'm talking about when I talk so make sure YOU know what you are talking about before you challenge me or any of my intentions/reasons.
Re: Re: Whoops! *ding* 1*Show me where I said you can't "I never said that. 2*Reading other posts on the board I see where disputing accurate derogs is considered "frivolous" because they are verified 95% of the time Diva ================ 1*And he never said (dispute" derogs.}Read tmitchells question again? 2*With a 70% percent error rate where do you find 95% to verify? I've run across a donkey around here now and then so when Steve demanded I delete my signature I selected this as a fitting replacement.LOL
How does a CRA verify that a tradeline is accurate? The most common way is to have an underpaid clerk "check" the computer. Other than that, what is considered as "verification" in a court of law and what law supports this "verification"?
Guys you deviated! Look at his question!!!!!!!! They are able to sue whether it is on your report or not. But IF it has passed your state's SOL for collection of debts you have an affirmative defense (means you have to raise it), and they will not win in court. No, they cannot re-age the account because you have woken them up. Just keep alert for them trying it. Good luck!
