who's responsible?

    I received a bill from 2/07 regarding an x-ray. I hadn't received anything from this company until approximately 3/09. I called my insurance company who informed me that the company never submitted the claim and the claim is now two years old and will not be honored. The medical company is billing me for this when it was their responsibility to submit for payment back in
    2007. Am I ultimately responsible? I recognize responsibility when insurance denies claims, but isn't that providing the bill is submitted timely? How can I prevent the bill from going into collections?

    Under Hippa law they have to submit this in a timely manner.
