wish me luck, pulled trigger on EQ

    I just filed my first lawsuit yesterday against EQ. Will keep everyone informed on how it goes. Wish me luck!

    I am also filing a lawsuit against Equifax. I am in discussions with an attorney now as I am trying to get him to take the case on contigency. I am suing for big $$$ and will not settle for deletions. I can't anyway if I get this lawyer to take the case on contigency. They have refused to delete teo accounts one which was opened fraudulently and one which was requested to be deleted by the creditor. I have letters from both of the creditors and copies of the UDF's they sent back in December. Also, a letter from Citibank (3rd creditor) stating that they have informed Equifax to update the account to show paid never late. Equifax refuses to correct the information, lied about investigating, and lied and said it was verified. Now we are going to court and they will pay and delete everything.

    Do yourself a favor, go to a car lot and get turned down a couple times. Then you got grounds for a MAJOR defamation suit. The principle behind that is if the CRA knows or should reasonably know what they are reporting is wrong, and when they recklessly go ahead and communicate such false information you got them for libel. Damages for libel per se can be on up there.

    In my case I went to apply for a checking account in sept last year and lo and behold the derogs on my nextcard account that were deleted in august were reinserted. Even got a copy of the credit report the bank pulled that shows the date of reinsertion. I'd like to see how they try and will weasle out of this one.

    So in addition to FCRA violations, I'm nailing them for libel as they published false information about me.

    But I'll gladly settle for deletion of my last two negative accounts and all hard inquiries in the last year. I'm going to send off to their attorney evidence that a relative fraudulently opened up one of the negative accounts and the other where the creditor has posted a bunch of bogus 30 day lates. The goal is to make it clear to them if their client EQ wants to keep listing those two accounts I'll sue them again for the same thing. By deleting both accounts they can be rid of me once and for all. At least till the next baddy shows up anyways.
