This is an apparent attorney network firm that is employed by MBNA. The question is ;"are they serious about litigation or are they trying to scare me?
Tom, I hate to tell you this but they are very serious. MBNA and this law firm have appeared on some other sites. What the law firm does is represent MBNA in arbitration and if they win, take the arbitrators ruling to state court for enforcement such as wage garnishment, lein on your house, or whatever your state allows. Hopefully, Why Chat will drift by and see the post. I know he has tried to help a few other posters at other sites who have found themselves in your sitaution.
They are very serious! They sued my wife for $600 on a Hechts Dept store account, then after they got the judgement, they tried a writ of execution on the bank we have our car loan through. Lucky for us the judgement was in her maiden name and the bank responded back as not having any accounts in her name, I promptly setup payment arrangements, paid off about half of it and never heard from them again..Watch out they are for real...
yeah, they pretty much suck. offer to settle low. don't give them too much info. and only correspond through the mail.
If you are within SOL , they will sue. They have, I believe, been stopped from trying to enforce the MBNA arbitration agreement as a tool in debt collection, but I am not sure.
