Ok, so I got my case dismissed within 30 seconds of the hearing. The plaintiff didn't even show up but I didn't get it dismissed based on failure to appear. When the judge asked me how I pled, this was my response "Your honor, I would like to Motion to Dismiss based on no documentation or original contract included in the Summons." Before I got the rest of my defense out the judge said motions granted. Then I asked if he would dismiss it with prejudice and he told me no. But when I got the letter in the mail it didn't have the box checked where it says dismissed without prejudice, what does that mean? Also, my main question is, how do I go about getting this illegitemate debt off my credit report? Any help would be appreciated. Thanks. I'm from Pennsylvania if that makes a difference.
OOps forgot to add: For anyone looking to get case dismissed, check the summons, did they attach anything? If not, but only a statement from the attorney, you've got a good case to get it dismissed as long as your Court Rules state that the original contract or documentation is required upon filing complaint. Also, when they don't attach anything, a good thing to do is come up with a defense for each sentence the attorney wrote on complaint. For me, he wrote about detriment to the company and the damage it caused. I replied back but didn't get that far with Considering the damage and detriment was already in place due to the need of the Federal Bank Bailout of 3.8Billion dollars. I think my judge would have loved that one. Also, I basically defended with the rest of being based on hearsay due to no evidence or proof. The best thing to do is do your research and read through all the laws in your state. I started researching the moment I got the summons and didn't stop until the day of. I had a good 3 page defense ready for the hearing. Better safe than sorry.
Any help from you guys would be great. Please tell me what my next step needs to be? Most of the information I have found has to do with default judgements not cases dismissed based on no evidence and what to do with the credit report? Please someone help me!!!! Bump?
