Won!!!!!

    From a no-longer-newbie.....

    Took Eugene Sand and Gravel to court for 3 violations(Basically amounted to a not mine issue).This was a first for me. After they refused delivery from the post office, I had the sherriff serve them and it still took nearly a month. Prepared for court by taking my paper trail and a copy of FCRA and FDCPA.

    They didn't show and I was awarded $3807:

    Violations: FCRA 623 Duty to provide notice of dipute

    FCRA 611 Procedure in case of disputed accuracy.

    FCRA 809 Validation of debts



    $1000 each (FDCPA 813 Civil liability)= $3000

    Court costs 124

    Prevailing Party Fee 60

    Other(I forgot what this was for) 623


    Total: $3807


    Thanks to Doc, Butch and Lizard King(in no particular order) and all the posters for the great information to make this happen.

    huge CONGRATULATIONS!

    i may need some tips - i will be taking a certain company to court for nonPP inquiries.

    Now for the rest of the story....

    Since they didn't show, I have to track down the $.

    I have filed a Writ of Garnishment and the sheriff will serve papers and I will be garnishing THEIR wages! All of this at their expense, of course.

    And... got a check for the full amount from their bank.

    Now, just need to make sure they fix the credit reports!
