I was looking through my Equifax report today and it has a section called : "Your Credit History information As Recorded By Equifax" Under : "Public Recorded Items" it lists a court docket number, an individual who sued me personally, the "balance amount" as $1700 and the "Account Status" as "judgement". For starters, this individual filed a small claims court case against me personally instead of the corproation of which I am the president of. In court I showed the judge the binding arbitration clause in the contract which made a court of law incompetent to try the matter, so the court appointed an arbitrator to hear the matter. At arbitration the woman who filed the claim went down in flames and lost, yet it appears someone reported this to my personal Equifax as a judgement against me. My question is, how do I find who reported this to Equifax as if I lost, as I clearly didn't, and have the records to prove it, so i know whom to file a complaint against, and what authority would I cite? I cannot tell from my Equifax report if this a negative on my report and if so, what number this lowers my FICO score, as I am trying to get a loan for my first home, but somebody needs to get sued for this gross error, but whom? Thanks all!
Last time I had a strange alias reported on Equifax, I called and asked who reported it. They gave me the phone number and address. Although our situations are different, I think that a phone call may suffice. But, in the meantime, like George said, NOT MINE.
I contacted "Jackie" at Equifax today and they informed me that it was their employees who went to the courthouse and obtained alleged records showing a judgement against me. I informed them back that the court would not have listed a judgement against me when the court referred it to arbitration and I won representing a corp, and that their employees were negligent in misinterpreting court records, and i was sufferign detriment as a result of their negligence, and would continue to be harmed till their investigation proved it should not have been on my report.I told instructed them to remove it immediately so as to reduce their liability, but they refused. Equifax told me it would stay on my report until their verification process showed otherwise. Now do I have a case yet and if so, under what particular rule have they violated......what's this "$1000" letter thing? Thanks all!
$1,000 LETTER~~BASICALLY is a letter that you can pay me $1,000 now or you can pay me $1,000 later with court fees and costs... You can also give them a 50% discount for paying $500 in 7 days... YOU HAVE NOTHING TO LOSE...
You need to go over to the courthouse and get a copy of the court papers so you can see exactly what the hell is going on.
