Wtf 1099-c!!

    I filed BK7 in 4/2003 and it was fully discharged 7/2003

    I filed on my former Credit Union accounts which includes the following debts:

    1) $5,000 Gold Mastercard
    2) $1,000 Overdraft protection for our checking account

    These of course was included in BK7

    recently I got forwarded mail which has my statement from that CU... I was like, HUH? I opened it..it just show $0 balance no activity... I decided to go to their website and try to log in...BINGO... I can access my old account that is still ACTIVE! WTF!?!?!?

    I decided to click eStatements....

    I noticed 1 thing....

    Opened it...it shows "Cancellation of Debt" with amount of $1,000 for VISA OVERDRAFT UNSECURED, this has been reported to IRS for my 2003 tax year...first of all I never got this form or any statements till recently just this 1 statement!

    Again...I thought that Creditors are not allowed to send 1099-C (Cancellation of Debt) if I filed BK7 which was fully discharged!!!

    Am I right? what should I do? IRS hasn't sent me anything noting the difference from what I filed my 2003 tax year?

    There should be a bankruptcy box on that form....and it should be checked.

    I just went back and checked it...yes it is checked...so am I off da hook with IRS? since they already reported to IRS and this is the first creditor to send that, not our 15 or so creditors!
