Xwife credit killing me

    I will try to make this short and include all the relevant facts.
    In 1993 my wife got a credit card in both our names ( without my
    knowledge) through a telemarketing call from Citibank.
    The card was never used and nothing was ever signed while we were
    married.
    We were divorced in June 2000, then , sometime in 2001 a card for that
    account was reissued to her.
    I found out about this account after applying for a personal loan in January
    of 2002. I then called the credit card company and began a 5 month series
    of phone calls were they ran me round in circles telling me there was nothing
    I could do ..it is a joint account and I am libel for all charges..the account
    was closed for non payment and at has a balance of over $4000.
    I have had an attorney send them letters stating they cease and desist but
    they say they have received none of them ..I have told them to prove it is
    mine and produce any evidence that it is or get it off my credit history , they
    basically have told me that I am out of luck they will not remove it .
    I am beginning to think I am getting screwed by both them and my
    attorney. I have notes from every conversation I have had with them and
    documented every time they change there minds on something and then tell
    me something else...can anyone help me please ..I would like to have my
    spotless credit history back ..WHAT CAN I DO?

    First of all, if your attorney is worth even two cents, he would have sent everything CRRR. Second, simply send a letter (CRRR) asking for your signature on an application. If they say it was a joint acct, then your signature needs to be somewhere. If they balk, file a lawsuit.

    Start by reading the Fair Credit Billing Act. Start hammering them on violations. Be prepared to sue them if you have to. They will keep jerking you around if you let them, but once they know you are serious, they will cave.

    I was in a similar situation. I was an au on exs credit cards and he defaulted before we were split up. I was being reported as a joint holder on them and they were showing up on my credit reports. I disputed with cra's and they all verified, so I statrted a letter writing campaign to all the corporate officers I could find and filed complaints with the FTC and my AG's consumer protection office and the BBB. I have only one left to get cleared up. Send certified letters to the credit/legal depts of the credit card company and demand they produce your signature on contract. After I got letters saying they would remove from my cr's, one of them sent their response to a BBB complaint saying they would not remove and that I benefited from the account! They sent copies of cancelled checks from our joint checking acct and charge slips. They thought that prooved it was a joint account. Their right hand didn't know what their left hand already did! If they think you won"t persue this, they won't do a thing about it! Keep on them and change attorneys!jlc

    They have admited at times that they do not have anything with my signiture on it and still they refuse to take me off. there contention is..the account was opened when I was married so therefor I am lible..even though no one used the account or signed anythign untill a year after the divorce.. and Just from reading some of the post on here i see that my attorny is either not even sending them letters or is very incompotent ..hence the old addage if you want something done right do it yourself. I thank all of you that have responded and those who have yet to respond to my dillema ..
