I JUST got back for the lawyer's office and he agreed to take the case. I'm unsure of what we are going for, but he's willing to do it pro bono. He also said he was VERY impressed with the papertrail as well as my knowlege of the FDCPA (thank you Creditnetters). He counted at least 10 violations, but because we were planning on buying a house within the next year, he MAY go after punitive as well as defamation of character. The only thing I forgot to bring with me was the estoppel, but I told him I quoted Englehardt Vs Gravens (MO) and he said it IS used appropriately, so I guess that helps all of us. I was more excited over him being impressed than the fact he was taking my case! LOL Thank you creditnetters!!! BTW I haven't even fully explained this to hubby, I ran right for the puter.

Congrats! I may be wrong, but I think you will get more money since it is being handled by an attorney. How wonderful that you impressed the attorney with your knowledge of the law! That must have really made your day
How can one go about suing a collection agency that is out of state? Small Claims only deals with cases filed against companies in your state.
Summer- Each state has their own set of laws, MY state I CAN sue someone out of state as long as the other person isn't in the military.
