Yes it can happen

    I was awfully shocked the other night on patrol when a car that was pulled over had an outstanding warrant from a nearby community. He was wanted for passing a bad check several months ago for an amount of UNDER 100 DOLLARS at a local retail merchant. Apparently the retailer turned the check over to collections, they tried to collect and he refused and played games. Fianlly the retailer went to the city prosecutor who had a warrant issued. Now in these cases for such petty amounts it sometimes is not worth it for the city who has the warrant to send officers to pick the person up. However they were hell bent on getting this guy and we were forced to hold him in our jail, I think he sat for about 36 hours before they came and got him. So thats just a heads up. People can be arrested and have criminal charges filed against em for writing a bad check and ignoring collection attempts. first time I have ever seen it. But It has happened none the less.

    Sure it can happen, in TX there are specific procedures a merchant must follow for the DA to take the check as a criminal charge. Many merchants just opt to go the civil route (CA's).

    Typically, they don't pursue minor violators, they hope to catch them in a traffic violation, and pick them up then.

    I ONLY USE CREDIT!!!

    If I didn't have a CREDIT CARD...I would use DEBIT...I would even use CASH as a last resort...BUT NEVER A CHECK!!!

    CHECKS ARE FOR PAYING BILLS BY MAIL WHEN YOU CAN'T PAY ON-LINE FROM YOUR CHECKING ACCOUNT OR WHEN YOU CAN'T HAVE THE BILL DIRECT CHARGED TO YOUR CREDIT CARD...

    I forgot to add my personal opinion, I think that in this case it was a waste of our time, the driver was V/NR (Valid , no restrictions) No priors or convictions. Looked like a first time offender to me. It tied up 2 cars for over 45 mins our jail officer to book him and space in our jail which is at a premium during March Madness with all the local bars. I wondering if maybe they tried and exausted all civil forms of collection. Either way it made for a long cold monday night on the freeway.
