Sears took a look at my credit file a year and a half after PP ended. They peeked, I sued, they pay. Sears hired an attorney - I went pro se. Their attorney just notified me Sears is paying me $1000 for pulling my credit file without permissible purpose. Settlement papers will be here shortly. And I was having such fun playing lawyer - now I have to go find another victim to sue. 4 down and a bunch left.
Awesome. What type of court did you file in? Federal or state, what level? I am fixing to go after a collection agency, and I am preparing my case and deciding what court to file in.
Local small claims. Sears hired a local lawyer and moved the case to Civil Court. Trial was to be Feb 6th. I buried them with pre-trial discovery and when they didn't respond I filed a Motion to Preclude any testimony or documents the Discovery would have shown (everything) and then, because they would be precluded from introducing any evidence or testimony, a Motion for Summary Judgement. The negotiations on the terms of the settlement are just starting, and removal of the offending inquiry will be part of it (although it comes off in September anyway). Sears has already (under threat of OTHER litigation) removed their two charge off trade lines from my CRA's. Suing your way to good credit can be so much fun, and so profitable.
