You Peek, You pay

    My next victim - WFS Financial - likes to look at its auto loan customers credit files often so they can turn those files over to marketing partners.

    Looked at mine 4 times in 1 year.

    $1,000 per peek, thank you - I will enjoy Acapulco this year courtesy of WFS Financial....

    Presumably this is a closed end loan in good standing.

    Are they looking soft, or hard?
    Did they send a GLB privacy notice?
    Did you reply and opt out?

    how do you keep track of your FICo score. I'm interested in keeping a close look to mine too.

    Yep, never a minute late.

    One hard, three soft. Makes no difference to me.
    I don't care about GLB Privacy Notice since it was to give to a "partmer" for marketing purpses, which is a FCRA violation regardless of GLB.

    I guess that makes them a "CRA", too.

    So when you get them to give you a copy of your "credit file", it should have an "inquiry" from their partner, who had no PP?

    Did their partner call you up and try to sell you something?

    I never got any offer from their parner (knowingly that is).

    Whether WFS is a CRA or not I don't know but there is no way what they did is PP under any interpretation of FCRA.

    Funny thing is..... they did the same thing to my wife at teh same time. HER summons goes out tomorrow.

    I'm not saying they are a CRA. Just that if they are obtaining CR information, and selling it to another user, they may become entangled in the legal obligations that CRAs are subject to.

    Sort of like the obligations of companies that create the tri-merged reports, but different than if they sell just their own customer information.

    Yes, but under FCRA we are two different people.
