your thoughts?

    I was wondering if someone could please answer this question or tell me if this has happend to them...I had a collection account paid off and i noticed 1 month ago when i was checking my cr that it was now showing as a duplicate account with a different account number as the original but it now saying that i owe 40 dollars on each account it was for 118 dollars and it says original credit limit/balace 118 past due 41$ on each one .....is there anyway to get atleast one of these accounts knocked off???

    • 1. Is the same CA reported the TL?
      2. Are both TLs reported with the same and the correct date?
      3. Have you contacted the CA?

    no i haven't contacted them yet....as you see i've disputed it with the cra and they wont budge but the ca and the dates are pretty much the same

      The CRA reports the TL-A again as TL-B probably because of the different name of the OC and the different account number. I assume you haven't received any letter from the CA, right? If yes, they are already in a violation.

      Is the name of the OC different on both TLs, or is it just a typo on your side?


      If they verified both accounts (which is a violation at least for the second one), you should send a "Debt Validation" letter to the CA and ask them to remove both TLs. Looks like they have messed up their files, because of that they have messed up youir CR and they should pay for it ...

    thanks for your help i cut and pasted it directly from my cr so it's not a typo on my part....now should i send validation for both accounts since they have different account numbers? and i your right i have not received any letter from them at all. should i mention this to them?? how should i word the the validation letter?

    What vghost is getting at is that CAs are prohibited from reporting inaccurate information, they are automatically in violation for claiming that they verified both accounts (since there's really only one). So yes, send them a letter on each account. Check the sample letters section on the main discussion boards page. I hope a guru can help you further.

      So, Lisa ... I see you've been around few months, but anyway - take a look at this - http://consumers.creditnet.com/straighttalk/board/showthread.php?threadid=53305 ...

      Now, Section §809(a) tells us that a debt collector have to send us a written notice with the following: the amount of the debt, the name of the creditor to whom the debt is owed, and few important statements. The debt collector must do this within five days after the initial communication with us.

      If we initiate the communication (as in your case), it doesn't matter what exactly we write to them, as long as it is about the debt. In fact, we can write them:
      • "Hey, you posted a negative TL regarding account #______ with <Name of Creditor> which contains an inaccurate information. What is it all about?"
      and this will trigger their obligation to send us the notice.

      Of course, a better worded letter is better respected. You may use it to ask them for additional information:
      - A proof that this debt is assigned or sold to them.
      - A proof that you owe this debt.
      - A proof that they are licensed in your state.
      - A proof how the amount is calculated.

      Send them two letters, one for each account, and tell them that they have reported inaccurate information about this account. They will be obligated to send you two notices, so the information in at least one of them will not be true. Then post here their responce (without any personal info).
