My husband opened up a Zales acct about a year ago and charged some jewelry to it. He never received a bill and when he went to the store to find out why, they called customer service for him and found out they had the wrong address on file. He asked them to correct the address and aksed what the minimum payment was and paid it at the store. Come next month, we still never receive a bill from Zales and he goes to the store again and makes another payment and customer service is called again. Still have the wrong address on file. WE apply for a mortgage and find out that Zales is reporting him as 30 days late twice. We call to find out why,and are told that he didn't pay the minimum. When he asks why they told him the wrong amount when he called and asked they said he must have made a mistake. He had called them 3 months in a row and asked what payment is due, and each month paid the minimum.

We paid it off and now are trying to get it taken off. They had the wrong address and are trying to blame it on him. And the address for the aplication was taken from his drivers licence which is correct so someone may have typed it in wrong.

We have called them several times and are getting nowhere. What can we do?

If the disputes had been in writing instead of verbal, you would have had recourse under the FCBA. You may still have, but the Act does specify written notice.

Instead of calling them, try finding someone higher up the food chain to write to. I would try a goodwill letter first, then get a little harsher if that doesn't bring the results you want.
