CSC Reinserted

    My Capital One Account today. Do you think I got a Credit Watch alert? nooooooo.

    But get this. This is what they deleted

    When they deleted it was showing a balance of $1652, with $208 past due, Last activity 7/2002, R4, and one each for 30, 60, 90 past due.

    I caught up the past due and then some in November.

    So the reinsertion reads:

    Balance $1652, Last Activity 7/2002, R1, 1 x 30 and 60 and 2 x 90. Date Reported 1/03.


    Remember I paid $350 dollars in November? My statement dated 12/8 shows a balance of $1354!

    Should I wait the 5 business days they have to notify me of reinsertion? Or should I throw a hissy fit immediately and demand the certification that this bs is accurate?

    Funny thing is, my FICO went up 7 points - go figure.

    Hi Lynn,

    Basically you'll want to wait and see. If you contact them now you may lose the violation and thus lose ammunition.

    Once the 5 days has expired and you get no notice, I'd go right for the jugular.

    They have 5 business days to postmark. Don't forget to allow for some mail time.

    Update -

    I received my report from CSC today with the results of an investigation. Buried in there is the Cap One acct saying "The Status of this Account Has Been Updated" "The prior paying history on this account has been updated".

    It originally showed deleted under the results of another investigation.

    Does this meet the requirement for notice of reinsertion?

    That is why you're score went up 7 points, because it went from R4 (currently past due), to R1 (current) even though the lates are still there you would get points b/c you are 'not curently late' This happened to me a couple of weeks ago, a CLOSED account 0 balance reported as 30 days late and my score dropped 100 points, b/c even though it was closed an 0 it was reporting as current status of past due, I had it removed the same week with the UDF and my score went back up 100 points.

    Thanks, that makes sense! I am also currently disputing 2 accts that have a -0- balance that are showing 120 days past due. How can you be past due on -0-? Maybe I should send them a check for $.00 and bring it current?

    OOPS, did I say my score dropped 100 from that late? SAcratch that, it dropped from 685 to 556. So that 1 late dropped my score 129 points, OUCH! I would just contact them and explain that it CAN'T be currently past due with a 0 balance. It's obvious to them as well.

    § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]


    (B) Requirements relating to reinsertion of previously deleted material.

    (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate.


    Great question.

    Once an investigation is conducted and an item is stamped "deleted" it falls into special catagory of info., "deleted" info.

    ANY item that falls into the "deleted" catagory is subject to

    § 1681i (b)(i).

    Lynn has confirmation that the item is in the "deleted" catagory.

    Of course they'll tell you that since the OC "re-reported" it then they are not required to notify you, but we all know how they lie.

    By the way Lynn, they also owe you a copy of the mysterious certification.
