I received a letter yesterday from my student loan agency who I've been fighting with for over a year about incorrect negatives on my credit. They admitted to making some mistakes and sent me a spreadsheet with 13 items that were incorrectly reported for almost three years to transunion and experian that they claim to have fixed. I have contacted them three times and Lexington Law has requested the items be verified on my credit report twice. I think I only got this response as I finally sent my dispute CMRR. I still have another 13 (these stupidly are correct) negatives on my credit from these people and I was wondering the best way to get them off. I was wondering about notifying them of my intent to sue as I now have proof provided from them that they did not verify the entries they made to my credit report for 12 months. What do ya'll think?
If this drama has been going on for 12 months--you need to get their attention. File a small claims lawsuit--it is extremely easy. You will then have their undivided attention. Ask that all negatives be removed and you will dismiss your lawsuit. Make sure to get it in writing.
Thanks I was thinking about doing that but was worried it would be expensive and time consuming. I travel alot for business, so can't necessary guarantee I can make a court date. But I guess if I can get them to settle the point is mute.
Opinions on my follow up letter?????? Dear Panhandle Plains Student Loan Center, While I thank you for finally correcting some of the issues I have addressed with your company regarding incorrect issues on my credit report, I am quite upset I had to go to such lengths to even have your company review my file. During just the past year, you have been contacted by the credit reporting agencies twice and by me three times to correct this matter so you have had ample opportunities to address these issues. These negative issues you claim to have deleted come to a total of 26 deleted derogatories. These negative remarks on my credit have caused job offers to be rescinded; denial of banking privileges and even further yet have made my car and home insurance rates increase. Some of your mistakes are as blatant as your reporting of the student loan 458-**-****** in amount $2002 that still remains as past due on my Transunion credit report despite the fact that this loan has never been disbursed. This still has not been removed from my credit file. I do not believe that you complied with FTC regulations when you repeatedly verified incorrect entries on my credit report and the spreadsheet you provided me with verifies this. I am offering you two options to deal with this matter- you can immediately remove all derogatory comments from my credit file or I will sue you in civil court for your violation of Fair Credit Reporting Act under which I am due $1000 for each false entry into my credit file plus court costs. As you repeatedly and admittedly reported 26 false derogatory comments on my credit file- you can easily see how very expensive this will be. I intend to retain an attorney 15 days from the date of this letter. I am quite confident I shall win this suit. Should you wish to settle this matter please contact me no later than the 27th of February, 2003. Sincerely, Me
I recently had all my student loan lates and collections notations removed from all 3 cra's. My loan servicer had been screwing up my loans for years and reporting eight accounts instead of four. I had repeatedly disputed this information only to have it always verified. You loan servicer should have a dispute resolution department, try contacting them. When I got in touch with dispute resolution I simply threatened to sue the snot out of them. After several conversation and several letters they agreed to delete everything including the accounts that were reporting correct. They were happy just to get rid of me. What company services your loans? EdG
Panhandle Plains Student Loan Center- the recent progress I think is due to sending a letter CMRR to the credit department and then threatening to sue. I am thinking that now that I have proof they so politely provided I have the upperhand and this threat to sue should be my last. I tried phone calls and got no results (and there was no verification of contact). So glad to see someone has had success in removing student loans.
