This is a follow up to my post "NCO/Cap1 offer" In short, Capital 1 and the Westmorland Agency ( affiliatte) are buying up old and uncollected debts from other creditors and sending these letters to consumers (in Illinois at least) and orchestrating what amounts to a scam designed to make consumers believe that these letters are not an attempt to collect on a debt but a second chance to rebuild your credit and also a scam in the sense that it doesn't make it clear that Capital one is acting 100 % as a bill collector for debts owed to others!!!! Cap1 is also a bottom feeder!! Highlights of lawsuit: Violations of FDCPA ACT15 USC 1692 ,and implementing Federal Reserve Board Regulation Z,12 C.F.R. part 226 and state law. Capital One is a "debt collector" as defined in the FDCPA with respect to delinquent account it aquires. Capital One Services and The Westmoreland Agency are also debt collectors as defined by FDCPA. Capital one purchased the debt from its prior owner. Letter exhibit does not comply with 15 USC 1692g (FDCPA). The notice is on the back of several documents. There is no reference on the front that there is anything on the back etc etc about purposeful obscuring of the document. Misleading statement about "even if you make a payment you still have 30 days to dispute the debt.This is incorrect and it violates 1692 g and e . The only payment contemplated in this letter is to the new credit card offered, not on the old debt. Once you have signed the contract in this letter, disputing the old debt is debt is meaningless. ---- When I read this letter it said that the collector was doing me a favor and getting Cap1 "out of the goodness of their heart" to assume "my old debt" and put it on a real Cap1 credit card. And that if I didn't accept the offer they would renew collection activity. The letter was sent by NCO but they are not the collectors !!!!!!! They are the debt sellers ! I thought that if I didn't take the deal I would face NCO. I was even thinking of sending NCO a validation letter but Wetmoreland agency (affiliate of Cap1 ) was the real party to send the validation letter to. HOW SNEAKY CAN THESE GUYS GET !!!
