Against the better judgement of everyone on this board (kicking self in a**) I disputed a charge-off as should have been included in BK (kicking self in a** again)

I received a letter back from TU today saying they are currently investigating the BK and the accounts included. To make a short story shorter...they want me to send them my discharge papers and the list of creditors included in my BK.

So what do I do now? I know I have read posts here that say not to send them anything but what do I do to get this reported right?

I know I should have disputed it as not mine (shoulda, coulda, woulda) but how should I handle it now?

In my first round of disputes w/ TU they requested my bk paperwork and I complied (of course it was before I knew of these boards). I did get 5 deletions out of 6. In my 2nd round of disputes, they also requested my bk paperwork. I ignored it and I got the deletion I wanted and the update to never late. I would go w/ the smart people here and just ignore the request.

I agree with kelcol. TU sent me the exact same letter. I ignored it and got the deletions anyway. It is a form letter, so just ignore it and do not send them anything.

what kind of letter did you guys use--Did you use the "not mine" Strategy or "included in bk" to get them deleted. My bk accounts are still showing as charge-offs and collections.

Denise, Dont use the included in bk dispute. Your first round of disputes should be "not mine". I started my credit fix in january 03. I am really starting to see some results.

I had the same deal..alot of accounts that were incl. in bk showing as charge offs (from 1996). Before I found these boards I had already disputed them (on TU) as incl. in bk and that is when they first asked for my paperwork and I stupidly sent them LOL...oh well u live u learn. Anyway w/ my 2nd round w/ them figured I had already burned that bridge so I used incl. in bk for one account and never late for another. (btw they deleted the incl in bk account) I disputed online too. Anyway, for a first round of disputes I would not mine (if I could go back in time) I am trying that route on the other 2 reports.... Good Luck!!

    Denise,

I had 12 chargeoffs which I disputed as "included in bk" and all were deleted. However, I did that before finding this board and WOULD NOT recommend that strategy now. I think I just got lucky--they could have changed all 12 to included in bk which would have made my overall credit repair journey all that more difficult.

If I were you, I would first dispute the chargeoffs and collections as "not mine." Let them investigate and hopefully they will be deleted. Remember to request validation from the CAs before disputing those with the CRAs.

So they have 30 days to do the investigating? What happens after the 30 days is up? Is it 30 business days or calendar days?

I disputed on 2/9/03 with TU and Equifax...Equifax has marked the account in dispute but I havent heard anything back from them yet.

With your deletions...did they automatically delete or did you have to send a letter or something?

Yes they have 30 days...I go by calendar days and they have always fallen w/in those 30 days. After the 30 days, if the CRA has been unable to verify what they are reporting they have to update/delete. You don't have to do anything unless they mess up!! Just sit back, wait and go to plan b if anything is "verified". You won't hear anything, unless they request information (which gives them an add'l 15 days if you comply) or until the end of the investigation when they should provide you w/ an updated copy of your report.

So did you send CRA letter telling them they must delete? Did you send ITS? Did you need to file suit? Sorry for all the question just interested in the process. Thanks!
