Does anyone know how I can take care of a collection showing on my credit report? It's from fingerhut, 3-4 yrs ago they said I owed them 91.00 from april 1997, I told them I didn't think I did, (because i lived in an apt. then and the letter was addressed to my first initial and last name). The lady I talked to said she would take care of it, and there was nothing to worry about, instead it was put onto my credit report by RJM Acquistions Funding in Nov. 2002, it says that it was opened 8/02, and it's a collection as of 11/02 and 10/02, and now it shows on my credit report that I have a delinquent collections account from within the past 9 months. I haven't been sent anything from RJM ever, the last I heard was the letter from fingerhut 3-4 years ago about this account. How can I take care of this especially since I don't know if it my account or not, I don't remember ordering anything from them. What letter would I write and to whom would I write it too? If anyone has a copy of a letter I could use it would really help, the only ones I am finding is if I received a letter from the collection agency itself, RJM has never sent me anything. I found out about them from my credit report. How did this go onto my credit report without them having any of my information including my first name? I would appreciate any help you can give me.
This Worked for me just last week. They will send you a computer printout saying this is the only info they have. After you get that you send them another letter telling them they must delete as it is not proper validation. they will then send you a letter saying they will delete> WALLST RJM Acq. Fund Sent via fax as address is unknown 516-714-1310 April 27, 2003 RE: Account #xxxxxxxxxxxxxxx Dear Sir/Madame: I recently have been looking at my TransUnion credit report, and I noticed that this account is being reported on it. I have never been sent anything from your company and all I have been able to obtain from the internet is your fax number. This is a notice that your entry on my credit report is being disputed. I am requesting validation according to my rights under the Fair Debt Collection Practices Act. I had requested validation from the previous company that had been calling on this and they were unable to provide it. Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation;" that is, competent evidence that I have some signed contractual obligation to pay you. A computer printout of the alleged debt from your company is not sufficient evidence, according to the Wollman opinion letter on the FTC website at http://www.ftc.gov/os/statutes/fdcpa/letters/wollman.htm. You must either validate this erroneous claim, or remove it immediately from my TransUnion report. I will hold your company liable for any damages as a result of this entry causing me to be declined for loans, credit cards, or any other credit that I have tried to obtain or will try to obtain while this listing is on my credit report. Sincerely, WALLST 239-xxx-xxxx wallst001@earthlink.net Good luck! WALLST
For all of you that have complaints about RJM, Fingerhut, Mitchell N. Kay, or Axsys National Bank you should read all of the terrible reports from others like us. They want to file a class action lawsuit, is this possible? I thought about letting them know about this message board so they would have somewhere to turn for help on clearing up their credit reports. I know that RJM should be sued they put a collection on my credit report that isn't even mine. Thanks to advice from WALLST I know how to deal with RJM and look forward to getting that problem resolved. I just thought this may help for anyone dealing with those companies. If you go to http://www.ripoffreport.com you can do a search on any of those companies they have quite a few complaints. This is the link I came across when searching the web for RJM, http://www.ripoffreport.com/reports/ripoff31517.htm http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=343127#post343127 THE END ** *** ** LB 59 """""""""```~~~```'"""""""""
I received a letter today stating that they were deleting. I sent them a validation and they didn't respond properly. Second, sent them an email stating that they did not provide proper validation and I also listed violation of the FCRA. Took about a week after the email to receive the letter.
I have them on two violations. 1) Did not notate account in dispute until a few days ago after they got the email. 2) Verfied during validation How could I make this an effective suit. I could sure use some extra money.
I just got their supposed validation documentation today. Could you post what you wrote in your e-mail and what e-mail address you sent it to or is it listed somewhere else on this board? Thanks, KAZ
Who sent you the information for validation. I cant remember the guys name that sent mine and I am not at home. Just search for another post with RJM acqusitions. In the email I just put info about their false validation and violations, delete or I sue.
Jamie Rozansky sent me the letter. I found his or her e-mail address so I sent them this letter using what was given above. A computer printout of the alleged debt from your company is not sufficient evidence, according to the Wollman opinion letter on the FTC website at http://www.ftc.gov/os/statutes/fdcpa/letters/wollman.htm I am once again advising that your entry on my credit report is being disputed. I am requesting validation according to my rights under the Fair Debt Collection Practices Act. Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation;" that is, competent evidence that I have some signed contractual obligation to pay you. I will hold your company liable for any damages as a result of this entry causing me to be declined for loans, credit cards, or any other credit that I have tried to obtain or will try to obtain while this listing is on my credit report. It should also be noted that the documentation provided by your company also shows that the last payment received on this account was posted on July 16, 1999. The Rules Of Civil Procedure of my State of Oklahoma provide a Statute Of Limitations limiting the time frame for any legal collection activities. The Statue of Limitations for Oklahoma is 3 years. The starting date of this statute of limitations being the later of the date of last activity, or the date of first default with the ORIGINAL CREDITOR of the subject account. Your immediate attention to this matter would be advised. Sincerely, KAZ1973 Hopefully I get a reply soon. Missed out on Getting 0% on new car because of all of this. Keeping my old one until I get it resolved. Thanks for your help on the letter.
Thanks. This board has really helped me out. Don't know what I would do without it. Kelly EQ - 5/02:544 6/03:627 Exp 05/02:577 06/03:600 TU - 05/02:571 06/03:618
