Experian's "unable to honor" letter

    I disputed 3 TL's with EX online, and they all came back verified.

    I then sent them a request for procedures letter very similar to the one on this site, and they sent me this letter.

    "We are unable to honor your recent request because we were unable to access your report using the identification information supplied. Please read the information below if you would like to order a copy of your personal credit report or if you would like to request an investigation of information on your report that you believe is inaccurate.

    The FCRA states "A consumer reporting agency shall require as a condition of disclosure that the consumer furnish proper identification" If you write to us, we must require all of the following information in order to process your request: full name, including middle name and generation, current mailing address and two proofs of the address (such as copies of your utility bill, drivers license, bank statement, etc), SSN, DOB, complete addresses for the past five years(including apartment numbers and zips)

    Is all this required? I am only asking for a procedure request (specifically: who did you call or write, at what address and phone number, what did they say, and what proof was provided), and restating my claim as goodwill. I did not ask for a copy of my report.

    How is it that everyone else can re-investigate and send procedures WITHOUT this info??

    I searched and found 2 others who have have experienced this, but they were not asking for procedures.

    HELP!!! Sorry for the long post.

    DON'T SEND A BANK STATEMENT!!!

    Why utilities are so important to them I have no idea!!!

    You can get a copy ON-LINE and copy it and send it to them with your DISPUTES...

    Or you can call and request one with-out all that GARBAGE!!!

    They are "required" to respond to consumer requests in a timely manner, as provided for in the FCRA. They are "required" to make sure that they provide your credit information either with certification of permissible purpose to others, or to you, the consumer, which indicates you must provide identification. This also is in FCRA.

    They are NOT "required" to get all the other information they say they "require", as a condition for responding to your legitimate request under FCRA.

    Provide basic identification, such as copy of drivers license and SS card, and if you get more flak, file complaint with your AG. Whether or not they want more, if you have identified yourself sufficiently, FCRA requires them to respond. The law puts specific requirements on them, not you.

    I'm guessing the reason why a "utility bill" in particular is requested because it confirms your actual living address rather than you mailing address.

    For example, I use a mailing address exclusively and do not receive mail where I actually live. Make sense?

    SO...I send you $1,000 and have my utility bills sent to your "LIVING ADDRESS" so you can pay them...do I then live there???

    Sure send the $1,000 (grin), I could use it!

    What I mean is this. If you have a credit card statement or a bank statement they only list one single address on the statement.

    You'll notice that utilities list your mailing address, but in addition they also list the address where the service is being provided. It would be easy for ID theft to happen if they just changed a mailing address on a statement, rather than setting up a utility bill (who would ever do that!) with a mailing address.

    Why not:
    1. Prepare a statement certifying under oath that you are the person named in the statement and that the address listed is yours;
    2. Take it to a notary public, SIGN IT IN THE PRESENCE OF THE NOTARY, and have the notary complete his signature and stamp on the statement;
    3. Send the statement with a cover letter and a copy of your driver license (of course it shows your correct address, right?) to the CRA.
    You have thus proven your identity, under penalty of perjury, sworn in front of a bona fide public official, and, you have only given out the information on your driver license.
    Is there a reason why this will not work?

    Did you include the REPORT NUMBER, with your request for procedures?

    Usually when they send the unable to honor response its because that (or your SSN) is not on the request.

    I know its ____, TU & EQ can quite easily pull up a report to dispute (or anything else) based on your name & address alone. EX surely should be able to as well.

    My personal opinion about the garbage that they are requesting, is that the reason they want it is so that if the letter does get misdirected in the mail, the person whom it gets misdirected to has more than enough information from you to steal your identity.

    The purpose of the FCRA & FACTA is to PREVENT IDENTITY THEFT, not to ENCOURAGE, ENABLE, and PROMOTE IT...
