my sister got her court date and in the letter it says she has to bring copy of bank statement for each account that shows the balance on the date she filed. The only two accounts she has is one that the bank closed for alot of nsfs and one she has with her soon to be ex..Does she really need to get proof of them? Hers has been closed for months before she filed and the one with her husband is in his name with her on as a authorized user?

Tell her to call her lawyer, or get clarification from the trustee. If they ask for statements, she MUST provide them, otherwise the trustee might rule to dismiss if she intentionally disregards this. Probably though what would happen is it would be continued to another date at which time you could produce them.

Never fool around with a bankruptcy trustee. they are not your friends. Her best bet is to consult her lawyer as soon as possible.

Thanks for the reply, I will tell her to call her lawyer or just go down and see if she can get copies. The account in her name is negative and the one they have together who knows because they are no longer together and from what we hear he is in jail facing ten yrs. I think what she is afraid of with the account in her name is that they will make her pay the negative balance right then and there.Who knows

also seeing they are seperated and she no longer uses this account does she have to ask him for permission to aquire about this info? Everything she is filing on is in her name only, they never purchased things in each other names.

1*How would she have statements on an account that she was only an AU on?
2*How does one produce what one don't have?

They can't make an AU pay anything.
This account has no business being involved with or in the BK.
It has nothing to do with it.

I don't see any reason to inquire about anything on this account.
All she has to do is tell them to remove her as an AU. Poof Problem Solved !

If the trustee asks for it, you have to produce it period. The only reason I can possibly think of for someone not wanting to produce bank statement is they have more money than they reported.

Well the one she had by herself is a whooping
-200.93 and she is working on getting another one from the bank they had together. The point was he was not filing and did not know even though they had this account together and everything that is being filed on is in her name only did the account matter. And by the way she did try to go to that bank and get a cpoy but all they have is monthly statements they are not set up to tell you what the exact balance on a certain day was.So I guess she will just have to find her bank statement for that month which let her tell it finished with $15.00

I just Don't see the connection! Will somebody explain this to me?
